The city of Newburgh and the town of New Windsor have agreed to share water in Brown’s Pond in the advent of an emergency, a move that settles a dispute over access that began back in April. That’s when the city put the town on notice that it was cancelling an earlier agreement to provide emergency water to New Windsor.
Since then, the town and the city have been unable to agree to a rate for water from Brown’s Pond, which the city operates and maintains even though it is located in New Windsor. The town of New Windsor draws most of its water from the New York City Aqueduct, which is occasionally shut down due to high turbidity, forcing the town to seek water from Brown’s Pond.
The new agreement will require New Windsor to pay the city of Newburgh the same rate it pays New York City, plus 15 percent. It also settles a lawsuit that New Windsor filed against the city late last year.
Newburgh City Manager Richard Herbek said that “we re happy to assist our neighbors by offering some of our excess water supply, so long as the costs of maintaining that supply are shared. “
New Windsor supervisor George Green said that the back up water supply is needed “only occasionally” but noted that it is important to have the alternate source of water.
