The testimony is relevant because Cosby is charged with giving pills to Constand, a former Temple University employee, to incapacitate her before their sexual encounter. The judge said he would try to schedule a new trial within 120 days. Instead, a publicist read a blistering statement from his wife, Camille, who had been in court during one day of the trial but was not at the courthouse Saturday.
The judge declared a mistrial, and prosecutors quickly said they would press their case against Cosby in a new trial with a new jury. He advised jurors when the trial ended, after a week of testimony and 52 hours of deliberations, that they need not discuss the case, even as the public debates whether age, race, gender or other issues separated them.
In a written statement, Troiani thanked prosecutors for raising awareness “that one of the hallmarks of drug-related sexual assaults is the effect the drug has on the victim’s memory and ability to recall, and were nonetheless willing to present this evidence to the jury”.
Constand lost consciousness after Cosby helped her to the couch and provided a pillow for support, she said.
Cosby faced three charges of aggravated indecent assault. But Montgomery County Judge Steven O’Neill only allowed one, Kelly Johnson.
